Updated 2026 Guide | Administrative Review Tribunal
Immediate steps, review rights, current ART fee and evidence strategy after an Australian partner visa refusal.
A partner visa refusal appeal may allow the Administrative Review Tribunal (ART) to reconsider an eligible Home Affairs decision. However, review is not available in every case, the filing deadline is strict, and the Tribunal cannot extend the statutory deadline for migration reviews under Part 5 of the Migration Act.
Current ART fee: AUD 3,727 for most migration reviews. A 50% fee reduction may be available where paying the full fee causes financial hardship. The required amount must be paid by the review deadline.
If a partner visa is refused, start with the decision notification. The letter explains the refusal grounds, whether review rights exist, who may apply, and the exact deadline. The choice between ART review, a new application, judicial review, or departure depends on the individual decision and visa status. For the underlying visa criteria, see VEM’s Partner visa Australia guide.
Partner visa refused: what to do first
1. Record notification
Save the decision letter, email, attachments, and the date and time the notification occurred.
2. Protect the deadline
Confirm the named review applicant and lodge a valid ART application with the required fee on time.
3. Check the visa status
Review VEVO, the bridging visa grant, and travel conditions before working or leaving Australia.
Do not wait to collect every relationship document before protecting the review deadline. The initial ART application should identify the decision and meet validity and payment requirements; detailed submissions and updated evidence can generally follow according to Tribunal directions.
The deadline in the refusal letter controls
Many migration review periods are short and are often described as 28 days, but the actual period can differ with the decision, notification method, applicant location, and detention status. ART states it has no power to extend the Part 5 migration review deadline.
Common reasons for partner visa refusal
A genuine relationship can still be refused if the legal criteria are not established by credible evidence. Common issues include:
- Insufficient relationship evidence: weak coverage of financial, household, social and commitment aspects.
- Inconsistencies: conflicting dates, addresses or relationship histories across forms, statements and interviews.
- Credibility concerns: implausible explanations, rehearsed evidence or documents that do not match ordinary conduct.
- Not meeting timing criteria: marriage, de facto duration or registration evidence not satisfying the requirement at the relevant time.
- Sponsor problems: sponsorship limitations, incomplete checks, character matters or prohibited sponsorship circumstances.
- Schedule 3 issues: an onshore applicant without a substantive visa failing to establish the applicable criteria or compelling reasons.
- Health, character or PIC 4020: separate statutory requirements not met despite a genuine relationship.
- Procedural omissions: missing requests, untranslated evidence, failed health checks or unanswered correspondence.

A review strategy should respond to the decision record paragraph by paragraph. Submitting hundreds of new photos without addressing a legal finding about sponsorship, Schedule 3 or character will not solve the central problem.
Can every partner visa refusal be appealed?
No. ART jurisdiction depends on the statutory review rights attached to the decision. Factors can include the partner visa subclass, whether the applicant was in or outside Australia, the location and status of the sponsor, who received the decision, and the legal provision used.
| Question |
Why it matters |
| Does the letter state ART review rights? |
It identifies whether the decision is reviewable, the eligible review applicant, and deadline. |
| Was it an onshore or offshore application? |
Offshore refusals may depend on sponsor-related Australian review rights. |
| Was sponsorship also refused? |
The correct decision or decisions and applicant standing must be identified. |
| Is the issue merits or legal error? |
ART reconsiders merits; a court considers jurisdictional legal error, not whether the relationship seems genuine. |
A court application is not a second merits appeal and cannot simply replace an expired ART deadline. Judicial review asks whether the decision-maker made a reviewable legal error. It usually has its own strict deadline, cost, and adverse-cost risk.

Partner visa refusal appeal process at the ART
1. Analyse the refusal
Identify each disputed criterion, adverse credibility finding, missing document, and factual misunderstanding.
2. Lodge a valid review
Apply through ART Online Services or the current M1 process, attach the decision, and pay the required fee before the deadline.
3. Obtain the case material
Review the Department file, original forms, interview records, submitted evidence, and reasons for refusal.
4. Build targeted evidence
Update the relationship record and explain discrepancies with documents rather than unsupported assertions.
5. Prepare submissions and witnesses
Connect facts to each legal criterion and prepare the applicant, sponsor and relevant witnesses to give honest evidence.
6. Attend and receive the outcome
Comply with hearing or case-event directions. ART may affirm, vary, set aside, substitute or remit the decision.
If ART remits the case, it usually sends the matter back to Home Affairs for reconsideration with directions. Remittal is a favourable review outcome but is not always an immediate visa grant; outstanding health, character, sponsorship or other criteria may still need assessment.

Evidence that can strengthen a partner visa appeal
ART generally reviews the matter afresh and can consider updated evidence. Strong material covers the whole relationship timeline and directly answers the refusal reasons.
Financial aspects
Joint accounts, transfers, shared liabilities, insurance, beneficiaries, major purchases and explanations of how expenses are managed.
Household
Lease or ownership records, bills, correspondence to the address, domestic arrangements and periods living apart.
Social recognition
Travel, invitations, family events, social records and detailed statements from people with direct knowledge.
Commitment
Relationship history, future plans, communication during separation, knowledge of each other and emotional support.
Quality and consistency matter more than volume. Date statements, explain unusual financial or living arrangements, and reconcile every discrepancy identified by Home Affairs. Form 888 declarations are helpful when specific and credible but do not replace primary records.

Partner visa appeal fee and other costs
Full ART migration review fee
AUD 3,727
Current fee for most Part 5 migration reviews.
Possible hardship amount
AUD 1,863.50
50% of the full fee, subject to ART approving financial hardship.
To seek reduction, provide the ART form and evidence of household income, expenses, assets, liabilities, rent or mortgage and bank accounts. ART instructs Part 5 applicants to pay either the full fee or 50% by the application deadline. If reduction is refused, the balance must be paid for the review to proceed.
ART refunds 50% of the fee paid if the reviewed decision is set aside or varied, or the matter is remitted to Home Affairs. Other potential costs include professional representation, translations, expert reports, updated health or police checks and a later court application. Fees change with indexation, so verify the amount on the lodgement date.
Partner visa appeal timeline in Australia
ART’s data for partner reviews finalised between 1 January and 30 June 2026 shows:
3 years 2 months
50% of partner reviews finalised within this time.
3 years 10 months
95% of partner reviews finalised within this time.
These figures describe completed historical cases and do not predict an individual review. Complexity, Tribunal workload, additional evidence, hearing availability and whether the case is ready for decision all affect timing. ART may expedite certain cases automatically or consider a supported request where its published criteria are met, but urgency is not guaranteed.
Bridging visa, work and travel during review
Lodging an ART review does not itself create unrestricted status or travel rights. An onshore applicant may have a bridging visa associated with the refused application, but its operation and cessation depend on the grant and review events. Check VEVO immediately and after every major step.
- Work: only work if the current visa or bridging visa permits it.
- Travel: a Bridging Visa A does not permit return after departure; a separate Bridging Visa B may be needed before travel.
- Address: update Home Affairs and ART separately where required.
- Relationship changes: disclose separation, family violence, sponsor death or other material changes and obtain advice about their legal effect.

Appeal or submit a new Partner visa application?
| Option |
Potential benefit |
Key risk |
| ART review |
Fresh merits assessment with updated evidence where review rights exist. |
Long wait, significant fee and no guaranteed outcome. |
| New application |
Can rebuild the file and address defects from the outset. |
May be barred onshore; new visa fee and same unresolved issue can cause another refusal. |
| Judicial review |
Can address jurisdictional legal error. |
Court does not re-decide relationship merits; deadlines, legal costs and adverse-cost risk apply. |
What partner visa refusal stories can teach
Published success stories can illustrate preparation, but they are not precedents or success-rate guarantees. These anonymised composite examples show common lessons:
Separate finances explained
A couple did not force artificial joint banking. They documented how rent, groceries and remittances were actually shared and supported it with records.
Contradictions confronted
Different first-meeting dates were acknowledged, traced to ambiguous wording and explained consistently with messages and travel records.
Living apart contextualised
Employment-driven separation was supported by rosters, flights, calls, visits and future cohabitation plans rather than photos alone.
Wrong issue, wrong evidence
A relationship-heavy response failed to address a sponsor limitation, showing why the legal refusal ground must drive the appeal.

Common partner visa appeal mistakes
- Missing the deadline while waiting for advice or documents.
- The wrong person applying for review or selecting the wrong decision.
- Failing to pay the required fee or hardship amount by the deadline.
- Repeating the original evidence without answering the refusal findings.
- Submitting inconsistent statements from the applicant, sponsor and witnesses.
- Assuming remittal means an immediate visa grant.
- Leaving Australia without checking bridging visa travel and return consequences.

FAQs
How long do I have to lodge an ART review?
Use the exact deadline in the decision letter. Review periods are strict and often short. ART cannot extend the statutory deadline for Part 5 migration reviews.
How much does a Partner visa appeal cost?
The current fee for most migration reviews is AUD 3,727. A 50% reduction may be approved for financial hardship, making the reduced amount AUD 1,863.50.
How long does a Partner visa ART review take?
For partner reviews finalised in the first half of 2026, 50% were finished within 3 years 2 months and 95% within 3 years 10 months. These are historical indicators, not guarantees.
Can I provide new evidence to ART?
Generally yes. Updated relationship evidence and submissions can be provided, subject to Tribunal directions. Evidence should target the refusal reasons and remain consistent.
Can I stay and work in Australia during the appeal?
That depends on the visa or bridging visa in effect and its conditions. Lodging an ART review does not itself grant unrestricted work or travel rights. Check VEVO and the grant notice.
Does winning at ART guarantee the Partner visa?
Not always. ART may remit the matter to Home Affairs for reconsideration. The Department may still assess outstanding visa criteria before deciding the application.
